Thank you for choosing to work with Mentor Education Ltd, we are excited to play our part in your child’s journey. We have been placing qualified, experienced and local tutors with London families for thirty seven years. We have a network of over two thousand tutors in London and have helped over ninety thousand pupils since 1982.

Child Protection Policy
Mentor Education Ltd carries out activities which bring our self-employed tutors and people working on behalf of our organisation into regular unsupervised contact with children and/or vulnerable adults. This includes providing tutoring and educational services in the students’ home and elsewhere. Mentor Education Ltd takes its responsibilities to safeguard and protect the interests of all young children very seriously. We have a full child protection policy on our website which indicates the way in which Mentor Education Ltd deals with such matters.

We would like to bring it to your attention that a supervising adult must be on the premises when our tutor visits on all occasions. This supervising adult must not leave during the period of the lesson. Should a Tutor arrive at your home and no supervising adult is present, they will refuse to conduct the lesson and leave. This is line with our mandatory policies. Should you ask them if you can leave for a time during the lesson they will say no.

Our Tutors are required to turn off all devices with a camera during their time in your home. Please ask them to do this if they have forgotten.

Illness and cancelling lessons
We do not expect your child to be tutored when they are ill, or contagious, so please do cancel a lesson in such circumstances. Please contact your tutor in the first instance if you need to cancel.

If you cancel within 24 hours of a lesson, you will be charged the full rate unless your child is ill.

**Your Relationship With Your Tutor **

Mentor Education Ltd acts as agent for your Tutor and will introduce the Tutor to you. Mentor Education is authorised to enter into the Terms with you on your Tutor’s behalf, and to administer your agreement with your Tutor. It is important that you recognise that the Terms relate to the provision of tuition as between you and your Tutor, and not Mentor Education Ltd.

Payments
Mentor Education’s registration fee of £50 is payable once you tell us you would like to proceed with tuition.*

The billing process is under the control of Mentor Education and we will send you an invoice at the end of each calendar month. Payment should be made directly to Mentor Education Ltd within 7 days of the date of the invoice.

Please call us if there have been any last minute or unpredicted changes to lessons during the month and we will amend the invoice straight away. Your Tutor shall be entitled to decline to attend Lessons where Tuition Fees are not paid.

Please do not pay our tutors for lessons.

Please pay by clicking on the electronic invoice we send to you via email and entering your card details directly onto our Tutorcruncher system. We also accept payment by bank transfer. We do not accept cheques. Please always include your child’s name as reference for payment. Our bank details appear on all invoices and on our website and are as follows:

Tuition Rates
Tuition Fees are charged by reference to your Tutor’s hourly fee rate for each hour or part of an hour of attendance at lessons. Mentor Education Ltd will notify you of the applicable hourly fee rate before lessons commence. Your Tutor reserves the right to change the hourly fee rate on notice to you.

Prices reflect the qualifications and experience of your tutor and will be advised to you by Mentor Education Ltd.

All expenses including books and travel must be agreed with the Tutor in advance.

Your Agreement with Mentor Education Ltd
You undertake that save as required by law you shall not at any time disclose to any person any confidential information concerning our business or our Tutors. You agree that you shall not engage or offer to engage any Tutor introduced by Mentor Education Ltd other than as agreed by us, as agent, for a Tutor in accordance with the Terms.

You further agree other than through our agency not to introduce our Tutors to any other person for the purpose of providing tuition. The restrictions accepted by you under this paragraph apply to you acting directly or indirectly and on your own behalf or on behalf of or in conjunction with any other person or firm.

In the event that you breach the provisions of this paragraph you will remain liable to us for all sums paid to the Tutor without deduction, which you agree to pay us, on demand, together with our costs. We shall also be entitled to obtain an injunction against you to prevent further breaches.

**Liability **

We will have no liability to you in respect of any arrangement you may choose to enter at your discretion with a Tutor. In the event that a replacement Tutor is required we will endeavour to provide a suitable alternative as soon as possible, however we will have no liability to you for our failure to provide an acceptable Tutor.

Our liability to you under the Terms is limited to the fees that you pay to us in respect of those services, although we do not exclude or limit our liability for death or personal injury caused by our negligence, fraud or any other liability that cannot be legally excluded or limited. We will not be liable for any failure to provide services where we are prevented from doing so by an event outside of our reasonable control.

If you fail to make any payment due to us under these terms we may apply interest on the overdue amount at the rate of 8% per annum above Barclays Bank plc’s base rate from time to time. Such interest shall accrue on a daily basis from the due date until actual payment of the overdue amount, whether before or after judgement.

**Study Environment **

You will ensure that your Tutor is provided with a safe and quiet study environment appropriate for study and that an appropriate and responsible adult is on the premises for the duration of each lesson at all times.

Privacy policy

We understand that privacy and security of your personal information is extremely important. Because of that, this policy sets out what we do with your information and what we do to keep it secure. It also explains where and how we collect your personal information, as well as your rights over any personal information we hold about you.

This privacy policy is served by Mentor Education Ltd and applies to you if you attend our events, or use our products or services online, over the phone, through our mobile applications or interact with us on social media. This policy gives effect to our commitment to protect your personal information and has been adopted by everyone in our business.

We collect information directly from you when you choose to participate in our offers and programs, use our systems, call, text or email us, or otherwise provide information directly to us. The following are examples of information we may collect directly from you:

Email Newsletter
We operate an email newsletter program, used to inform subscribers about products and services supplied by Mentor Education Ltd. Users can subscribe through an online automated process should they wish to do so but do so at their own discretion. Some subscriptions may be manually processed through prior written agreement with the user.
Subscriptions are taken in compliance with UK Spam Laws detailed in the Privacy and Electronic Communications Regulations 2003. All personal details relating to subscriptions are held securely and in accordance with the EU General Data Protection Regulation 2018.
No personal details are passed on to third parties nor shared with companies / people outside of the company that operates this website.
Under the EU General Data Protection Regulation 2018 you may request a copy of personal information held about you by Mentor Education Ltd newsletter program. If you would like a copy of the information held on you please write to the business address at the bottom of this policy.

Email marketing campaigns published by Mentor Education Ltd or its owners may contain tracking facilities within the actual email. Subscriber activity is tracked and stored in a database for future analysis and evaluation. Such tracked activity may include; the opening of emails, forwarding of emails, the clicking of links within the email content, times, dates and frequency of activity [this is not a comprehensive list].

This information is used to refine future email campaigns and supply the user with more relevant content based around their activity.
In compliance with UK Spam Laws and the Privacy and Electronic Communications Regulations 2003 subscribers are given the opportunity to un-subscribe at any time through an automated system. How do I get my name removed from Mentor Education Ltd mailing list?
Each mailing we send you will contain details of how you can unsubscribe. Please follow unsubscribe instructions or alternatively send an email to [email protected] with the word ‘remove’ in the subject line and the email address that you wish to be removed within the email. Please note that it may take up to 28 days to action your request.

Communication, engagement and actions taken through external social media platforms that Mentor Education Ltd and its owners participate on are custom to the terms and conditions as well as the privacy policies held with each social media platform respectively.
Users are advised to use social media platforms wisely and communicate / engage upon them with due care and caution in regard to their own privacy and personal details. Mentor Education Ltd will never ask for personal or sensitive information through social media platforms and encourage users wishing to discuss sensitive details to contact them through primary communication channels such as by telephone or email.
Our website may use social sharing buttons which help share web content directly from web pages to the social media platform in question. Users are advised before using such social sharing buttons that they do so at their own discretion and note that the social media platform may track and save your request to share a web page respectively through your social media platform account.

You have the right to access the personal information that we hold about you (as defined in the EU General Protection Data Regulation 2018) upon receipt of a written request.
Before providing personal information to you or another person on your behalf, we will ask for proof of identity and sufficient information about your interactions with us that we can locate your personal information. If any of the personal information we hold about you is inaccurate or out of date, you may ask us to correct it.

You have the right to object to us processing your personal information if we are not entitled to use it any more, to have your information deleted if we are keeping it too long or have its processing restricted in certain circumstances.

Tutors Terms and Conditions

This is a contract between Mentor Education Ltd and you, the Tutor. This contract supersedes any other contracts previously agreed between both parties.

The following arrangements are understood and and agreed by both parties:

General:

Once a tutoring position has been confirmed, you are entering into a contract between you (The Tutor) and the Client (The student’s parent or guardian). Mentor Education acts as an agent on behalf of the Tutor and the Client. Mentor Education is only responsible for finding students an appropriate teacher and is not responsible for the content of lessons and the teaching methods.

The terms of contract entered into with the client shall be in the form provided by Mentor Education Ltd unless otherwise agreed by Mentor Education Ltd.

Private Arrangements

In consideration of Mentor Education Ltd providing you with students, you are not permitted to make private arrangements for tuition with clients introduced by Mentor Education Ltd or with new clients introduced to you by Mentor Education Ltd clients.
Should you breach this obligation, you will be liable to account to Mentor Education Ltd for all sums received by you from the client/ new client without deduction and Mentor Education Ltd shall be entitled to obtain an injunction against you to prevent further breaches. This obligation shall continue notwithstanding termination of this Agreement.

Any work referred to a Tutor by a Client of Mentor Education Ltd must be billed through Mentor Education Ltd on your behalf. We give a referral fee to all Tutors who pass clients to us but Mentor Education Ltd must process the billing.

Profiles

Mentor Education Ltd uses your profile to inform parents of your experience and attributes and needs your Tutorcruncher profile to be kept up to date. This includes a recent photograph of you. You must select all the subjects and levels you would like to teach in order to be considered for the work you are hoping to obtain.

Environment

You and the client are responsible for finding and agreeing on a suitable environment in which tuition can take place. You must never agree to teach a child in their bedroom under any circumstances. Please remain in a public area of the house with doors left open.

Payment

Mentor Education Ltd will agree the fee structure with the client and this must not be changed without the written authority of Mentor Education Ltd.

As part of our service as your Agent, we will collect the fees due from clients and pass them on to you, net of commission. Mentor Education Ltd invoices clients on behalf of Tutors based on the lessons entered and confirmed on Tutorcruncher.

Please ensure that you have entered all your lessons and agreed expenses onto Tutorcruncher prior to the end of each calendar month to ensure you are paid promptly. If lessons are not entered by the end of the calendar month they will not be invoiced to clients for a further calendar month resulting of a delay in payment to you by a month. Payments will only be made to you once the invoices have been paid by the client.

You will not be paid directly by the client. Mentor Education Limited sends an invoice to the client, on behalf of and as an agent for you (the Tutor) on the final day of each calendar month to cover all that month’s tuition. Our payment terms are 7 days.

You must not accept any payment direct from the client under any circumstances. Should you do so, all sums received by you will be immediately payable to Mentor Education Limited and shall be actionable through the Courts without further notice to you.

You undertake to Mentor Education Ltd that you will duly pay tax and national insurance contributions which are due from you, whether in the United Kingdom or elsewhere, in relation to the payments to be made to you by Mentor Education Ltd under this agreement and further to indemnify Mentor Education Ltd in respect of all and any income tax or National Insurance which may be found due from Mentor Education Ltd on any payments made by you under this agreement together with any interest, penalties or gross -up thereon.

For the purpose of record keeping, you will account for the full fees due from the student as income and the commission as expenditure. It is understood that you are not VAT registered. You must inform us of this is not the case, or if this changes.

Expenses

All expenses such as books and travel must be agreed with the client before you add them onto your invoices. If you buy books, please keep receipts so you can return them to the shop if the client does not want to buy them. Do not charge for travel in central London. Any expenses incurred by you without the agreement of the client will not be reimbursed to you.

Cancellation policy

Both the Tutor and the client must notify the other in advance of any holiday commitments they may have, and any changes to the tuition timetable necessary due to illness. An alternative date should be arranged. Mentor Education Ltd recommends that you agree a 24 hour cancellation policy with the client so that Mentor Education Ltd can charge them on your behalf if they cancel the lesson at short notice. You need to have agreed this and the chargeable cancelled hours with the client before Mentor Education Ltd will charge for them. The Tutor must notify Mentor Education Ltd as soon as possible and within 24 hours of the time of the original lesson in case of a late cancellation to claim the charge.

Damages

Mentor Education Ltd do not accept any liability for any claims by the client arising out of or related to the carrying out of the tutoring by you and you agree to indemnify Mentor Education Ltd without limit in respect of any such claims.  

Confidentiality

You undertake that you shall not at any time during this agreement, and for a period of five years after termination of this agreement, disclose to any person any confidential information concerning the business affairs customers, clients, suppliers of Mentor Education Ltd except that you may disclose Mentor Education Ltd’s confidential information as may be required by law, court order or any other government or regulatory authority.

You shall not use Mentor Education Ltd’s confidential information for any purpose other than to perform your obligations under this agreement.

Furthermore you agree to the following values we hold central to our educational aims:

• I agree to provide students with an appropriate, balanced and challenging course of study to help motivate, develop confidence and inspire them to reach their full potential.
• I understand my role as a tutor is to guide students’ to do their own work using the best learning approach possible.
• I will demonstrate faith in each student’s learning abilities understanding my primary goal is helping them discover and develop skills needed to reach their desired educational outcomes.
• I understand my relationship to each student is professional and not personal.
• I will always conduct myself in a professional manner and will not consume alcoholic drinks, illegal substances or smoke either immediately prior to or during a lesson.
• I will not use a mobile phone or camera in any of my lessons and I will switch these devices off when I go into the home of my students.
• I will not post or comment on Mentor Education Ltd, on any of my students or my interactions with them on any form of Social Media.
• I will respect and be sensitive to students’ cultural background and personal value system; keeping in mind their personal dignity.
• I recognise I will not have answers to every question asked. Therefore, I will seek assistance in finding answers to the student’s questions and/or directing the student to “how” and “where” appropriate resources are for the information needed.
• I will be on time for all appointments, maintaining high standards with regard to language, manners, presentation and preparation ensuring that the time spent with students is a positive experience.
• I will keep information about all students I work with confidential.
• I understand the ultimate goal is to assist students in discovering how he/she best learns. I will accomplish this by helping each student develop the skills needed to achieve their best educational outcome. I will also remain flexible to my approach to student learning, respectful of the various learning styles and preferences.
• I will maintain a contemporary approach in both my subject area(s) and learning methodologies., keeping up to date with latest methods and developments relevant to my practice.
• I will share techniques for improving study skills with students; respecting their differing learning styles and preferences while exhibiting excellence in my approach to the content being tutored.
• I will provide honest feedback in the form of positive praise and/or constructive suggestions to students I serve in a manner beneficial to their overall learning.
• I will not take part in any form of plagiarism, such as completing a student’s homework for them.
• I will provide records, lesson plans and progress data as expected and required.
• I will maintain accurate records of tutoring sessions to fulfil expectations & requirements which exemplify excellence in tutoring.
• I will not seek to provide educational services introduced by Mentor Education independently of the Company.
• I will provide Mentor Education ltd with a copy of my Enhanced DBS certificate and proof of my right to work in the UK (such as passport, national insurance number, relevant work permit / visa).
• I agree to keep my Enhanced DBS Certificate current and up to date annually.
• I will abide by Mentor Education’s Safeguarding and Child Protection Policy.
